GO SWIFT RIDER RENTAL AGREEMENT
Effective Date: April 5, 2025
This Rider Rental Agreement ("Agreement") is entered into by and between **Go Swift LLC** ("Company") and the undersigned rider ("Rider"). By accessing or using any services provided by Go Swift, including renting and operating Go Swift electric scooters ("Scooter" or "Scooters"), Rider agrees to be bound by the terms and conditions set forth in this Agreement.
1. Acceptance of Agreement
By using Go Swift's services, Rider acknowledges that they have read, understood, and expressly agree to all terms and conditions contained in this Agreement, as well as Go Swift's Privacy Policy and any additional policies or guidelines provided by the Company.
2. Modifications to Agreement
Go Swift reserves the right to amend, modify, or update this Agreement at any time. Any changes will be effective upon posting the revised Agreement on Go Swift's website or mobile application. Rider's continued use of the services after such changes constitutes acceptance of the revised Agreement.
3. Rider Representations and Warranties
Rider represents and warrants that they:
- Are at least 18 years old or the minimum age required by local law to operate an electric scooter.
- Possess a valid government-issued identification.
- Are physically and mentally fit to operate the Scooter safely.
- Will comply with all applicable traffic laws, regulations, and ordinances.
- Will not operate the Scooter under the influence of alcohol, drugs, or any other substance that may impair their ability to operate the Scooter safely.
- Will not carry any passengers or allow others to operate the Scooter.
- Will not use the Scooter for commercial purposes, including but not limited to food delivery or courier services.
4. Use of Scooter
Rider agrees to:
- Conduct a basic safety inspection of the Scooter prior to each use, including checking the condition of the wheels, brakes, lights, and battery level.
- Promptly report any defects or issues with the Scooter to Go Swift.
- Use the Scooter only within the designated operational area specified by Go Swift.
- Park the Scooter in designated areas and in a manner that does not obstruct pedestrian pathways, driveways, or access points.
5. Prohibited Acts
Rider shall not:
- Tamper with, modify, or dismantle any part of the Scooter.
- Attach any baskets, stickers, or other items to the Scooter.
- Use the Scooter to carry heavy or bulky items that may impede safe operation.
- Engage in reckless riding, including stunt riding or racing.
- Ride the Scooter on sidewalks, highways, or any areas where such operation is prohibited by law.
6. Assumption of Risk and Release of Liability
Rider acknowledges that operating an electric scooter involves inherent risks, including the risk of accidents, injury, or death. By choosing to operate a Scooter, Rider assumes full responsibility for these risks. Rider agrees to release, indemnify, and hold harmless Go Swift, its affiliates, employees, and agents from any claims, damages, or liabilities arising from Rider's use of the Scooter, except to the extent such claims arise from Go Swift's gross negligence or willful misconduct.
7. Fees and Charges
Rider agrees to pay all applicable fees associated with the rental and use of the Scooter, including but not limited to:
- Rental Fees: Calculated based on the duration of the ride as specified in Go Swift's pricing structure.
- Unlocking Fees: A fixed fee charged at the commencement of each ride.
- Late Fees: Applicable if the Scooter is not returned or properly parked within the designated time frame.
- Damage Fees: Costs associated with repairing or replacing the Scooter or any of its parts if damaged during Rider's rental period.
All fees are subject to applicable taxes and other local government charges, which may be charged and collected by Go Swift.
8. Payment and Billing
Rider authorizes Go Swift or any of its affiliates to charge the provided payment method for all fees and charges incurred. Rider is responsible for maintaining accurate and up-to-date payment information. Failure to settle outstanding charges may result in suspension or termination of access to Go Swift's services.
9. Term and Termination
This Agreement commences upon Rider's first use of Go Swift's services and continues until terminated by either party. Rider may terminate this Agreement by ceasing all use of the services and deleting their account. Go Swift may terminate this Agreement and Rider's access to the services at any time without notice if Rider breaches any terms herein.
10. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of Washington, D.C., without regard to its conflict of law principles. Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts located in Washington, D.C..
11. Miscellaneous
- Severability: If any provision of this Agreement is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.
- Waiver: The failure of Go Swift to enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision.
- Entire Agreement: This Agreement, along with Go Swift's Privacy Policy and any additional terms incorporated by reference, constitutes the entire agreement between Rider and Go Swift concerning the subject matter herein.
By using Go Swift's services, Rider acknowledges that they have read, understood, and agreed to be bound by the terms and conditions of this Rider Rental Agreement.
